Terms of Service

1. Acceptance of Terms

By creating an account, downloading our app, or otherwise using Club90, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.

2. Description of Service

Club90 is a mobile application that helps users organise sports matches, track personal and group statistics, and connect with local sports communities. The service is operated by Club90, based in Johannesburg, South Africa, and available on iOS and Android.

3. Account Registration and Eligibility

You must be at least 13 years old to create a Club90 account. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed these Terms and consented to your use of the service. You are responsible for the accuracy of your account information and the confidentiality of your credentials. One account per person.

You retain ownership of content you post (match comments, group chats, photos, statistics, votes, and similar). By posting, you grant Club90 a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and distribute that content within the service for as long as your account is active.

We may, at our discretion, remove or hide content that violates these Terms or that is reported by other users. You may delete your own content at any time; some content may persist in backups for a limited retention period before being purged.

6. Intellectual Property

The Club90 name, logo, badges, written content, and all underlying software are owned by Club90 and protected by South African and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on Club90 content without our prior written permission. We grant you a limited, non-exclusive, non-transferable licence to use the service for personal, non-commercial purposes.

7. Third-Party Services

Club90 relies on third-party services to operate, including Supabase (data hosting), Apple Push Notification service and Google Firebase Cloud Messaging (push notifications), Vercel (web hosting and analytics), and Resend (email delivery). Your use of Club90 is subject to those providers' terms where applicable.

8. Disclaimers and Limitation of Liability

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, including the South African Consumer Protection Act, Club90 is not liable for indirect, incidental, consequential, or punitive damages arising out of your use of the service. Where the law does not permit a full limitation, our total liability is limited to the amount you paid us in the twelve months before the claim — which, for free use of Club90, is zero.

You play sports at your own risk. Club90 is a coordination and record-keeping tool; we are not responsible for the conduct of other players, the condition of venues, injuries sustained during matches, or disputes between users.

9. Termination

We may suspend or terminate your account if you violate these Terms or use the service in a way that harms other users. You may delete your account at any time via the in-app Settings or by submitting a request at club90-orcin.vercel.app/delete-account. Deletion is processed within 30 days.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Johannesburg, South Africa.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
